It All Comes Down to the InsuranceFighting for Coverage of Your Personal Injury AccidentWhen you need them the most, insurance companies can turn against you. Although you’ve been badly hurt in a crash, some insurers will go all the way to trial to avoid paying on your policy. The personal injury lawyers of The DeVoto Law Firm fights back to force the insurance company to honor its obligation. We have extensive experience in car accidents and trucking accidents, including litigation over uninsured motorist/underinsured motorist policies. Call 866-961-0330 for a free consultation. We serve Greater St. Louis and eastern Missouri. Our attorneys will explain your insurance coverage and go as far as necessary to secure your just compensation. What If the Other Driver Can’t Pay?There are two main parts to your auto insurance policy:
Scenario #1: The other party was driving without insurance. Your uninsured motorist policy pays off your medical bills and lost wages. Scenario #2: The negligent driver has insurance, but your losses exceed their coverage limit. Yourunderinsured motorist policy (depending upon how it is written) can pick up the difference or at least up to the policy limits Scenario #3: Your losses are greater than the limits of your UM insurance. But Missouri allows “stacking” — each vehicle you own is insured for the UM policy limit, and you can combine these coverages. Please note that under most instances, UIM coverage cannot be “stacked”. What If Your Insurance Company Won’t Pay?Theoretically, you are fully covered in each of the above scenarios. In reality, insurance companies routinely try to deny or limit uninsured motorist and under insured motorist claims. They may not inform you of your right to stack coverage — or argue that you can’t. Uninsured/under insured litigation is tricky, especially if multiple drivers are involved (some with insurance, some without). Your attorney must be familiar with the case law and interpreting insurance policies. With over 30 years of experience, trial lawyer Tom DeVoto can determine when UM/UIM applies and whether it should cover all your losses. If your insurer won’t settle the claim, he prepares for trial to convince a jury that the policy and the insurance laws of Missouri are on your side.
